§1 Scope
- The following terms and conditions apply to all orders via our online shop, which apply to Affengeile Bilder GmbH., Kreuzhofstraße 5, 88161 Lindenberg i. Allgäu , Germany and the consumer (hereinafter referred to as the customer).
- Our online shop is aimed exclusively at consumers (customers).
A consumer is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
- Our services, benefits and deliveries are carried out exclusively on the basis of the General Terms and Conditions listed here, provided that these have been effectively included in the contract.
§2 Contractual partner, conclusion of contract
- The purchase contract is concluded with Affengeile Bilder GmbH.
- By placing the products in the online shop, we make a binding offer to conclude a contract for these items. Our products can initially be placed in the shopping cart without obligation and entries can be corrected at any time before sending the binding order by using the correction aids provided and explained in the ordering process. The contract is concluded by clicking the order button. The offer for the goods contained in the shopping cart is accepted. Immediately after submitting the order, a confirmation will be sent by email. The purchase contract is concluded with this email confirmation.
- Changes and cancellations can no longer be accepted at this point.

- The language available for concluding the contract is German.
- We reserve the right to reject orders if they do not meet Affengeilebilder24's specified requirements or if the customer is not creditworthy.
§4 Copyrights
- Affengeilebilder24 has been granted an unrestricted right to use the images of the respective partners which are offered on our website affengeilebilder24.de. Furthermore, there is the right to use them for all products offered on the site and to grant the customer a respective right of use for their end product. The purchased products are therefore free of third-party rights.
- This does not include rights of use for reproduction of any kind, distribution, modification, processing, making publicly available or commercial resale. Our products may only be used for private use.
§5 Customer obligations
- By uploading files, the customer confirms that he has the right to distribute and reproduce the contents and materials of this file.
- All files and their contents that the customer makes available to affengeilebilder24 do not violate any applicable rights. The customer assures this by handing over the files.
- The customer guarantees
a) that there are no illegal templates, materials and content that glorify violence, hate speech, racist content, propaganda materials, symbols of unconstitutional parties or their substitute organizations or instructions for criminal offenses, pornographic templates, materials or content that are the subject of sexual abuse of children or sexual acts with animals and no discriminatory statements or representations regarding race, gender, religion, nationality, disability, sexual preference or age are sent to affengeilebilder24;
b) that no laws for the protection of young people or criminal laws are violated. This applies in particular to the legal regulations of Sections 184 ff of the Criminal Code (dissemination of pornography), 185 ff of the Criminal Code (insult, slander, defamation) as well as to the provisions of the State Treaty on the Protection of Minors in the Media;
c) that the templates (particularly image and text files), content and materials sent to affengeilebilder24 do not violate any third-party copyrights, trademarks or other intellectual property rights, general personal rights or other third-party rights.
§6 Delivery conditions
- Shipping costs may apply in addition to the stated product prices. You can find out more about any shipping costs that may apply here .
- We only deliver by mail. It is not possible to collect the goods yourself.
- Partial deliveries are permitted up to a quantity acceptable to the customer.
- We always endeavor to adhere to the delivery times stated after the contract has been concluded. If, in exceptional cases, we are unable to meet the deadlines, the customer is free to withdraw from the contract within the framework of the following provision.
- The duration of the grace period is two weeks. The deadline begins when the customer sets the grace period. The aforementioned does not apply if setting the grace period is unreasonable for the customer. This is particularly the case if there is a so-called fixed transaction or the customer's interest in setting a grace period no longer applies for compelling, legally permissible reasons.
- In the event of delivery disruptions that are not within our control (particularly due to force majeure) and were not caused by us culpably, we are entitled to withdraw from the contract, provided that the hindrance to performance is not only of a temporary nature. We will not be in default during the time of the obstacle. The purchase price already paid will be refunded in the event of cancellation.
- For shipping, we pass on the postal and, if available, email address to our shipping service provider so that the package can be delivered and the customer can also receive information in advance about the time of delivery from the shipping service provider. This transmission takes place on the basis of §5 PDSV (Postal Service Data Protection Ordinance) and §28 Paragraph 1 BDSG (Federal Data Protection Act) as part of the shipping order between us and the shipping service provider for the purpose of delivery and does not require the recipient's consent. The shipping service provider processes this data exclusively for this purpose and for no other purpose. The data is collected on an order/shipment basis and, within the framework of the legal requirements for archiving periods, is also stored on a shipment basis in our databases, for example for complaints and billing purposes.
- Shipping costs of all kinds including packaging, transport costs, transport insurance and deliveries will be invoiced to the customer. Prices and additional costs are calculated according to the current shipping prices.
- Additional shipping costs that arise due to incorrect or missing address or delivery data will be charged to the customer if the customer is responsible for the incorrect information.
- Delivery within the EU is duty-free. When delivering to countries outside the EU, especially Switzerland, the customer is responsible for any customs duties, taxes and other fees that may arise.
§7 Payment conditions
- At the time the contract is concluded, the purchase price is due immediately and will be debited in advance. The credit card will be charged after the order has been completed.
- All prices are end customer prices and are shown including statutory sales tax.
- If the customer does not meet his payment obligations, reverses or stops payments or other circumstances become known that call the customer's creditworthiness into question, we are entitled to demand payment of the entire remaining debt.
The following payment methods are available in our shop:
- Payment in advance
If you choose the advance payment method, we will provide our bank details in a separate email and deliver the goods after receipt of payment.
- Credit card
When the order is placed, the customer's credit card details are sent to us at the same time.
Once you have been authenticated as a legitimate cardholder, the credit card company will be asked to initiate the payment transaction immediately after placing your order. The payment transaction is carried out automatically by the credit card company and the card is charged.
- PayPal, PayPal Express
During the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, the customer must be registered there or must first register, his access data will be legitimized and the payment instruction will be confirmed to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. The customer receives further information during the ordering process.
- Immediately by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, an online banking account with a PIN/TAN procedure that has been activated for participation in Sofort must be available, you have to be identified accordingly and the payment instruction to us is confirmed. The customer receives further information during the ordering process. The payment transaction will be carried out by Sofort immediately afterwards and the account will be debited.
§9 Voucher conditions
- Gift vouchers can be redeemed for the purchase of our products (with the exception of other gift vouchers) in our online shop www.affengeilebilder24.de. Redemption from other third parties is not possible.
- Our gift vouchers do not expire.
- The commercial resale of gift vouchers is not permitted. The value of a gift voucher is neither paid out in cash nor interest.
- To redeem a gift voucher when ordering online in our online shop, the voucher code on the gift voucher must be entered into the relevant field in the online ordering process before completing the online ordering process.#
- A subsequent redemption or settlement of a

- A payout of the cash value is not possible.
§10 Retention of title
- The products remain the property of affengeilebilder24 until full and final payment has been made.
§11 Limitation of liability
- Unless expressly agreed otherwise below, the statutory liability law for defects applies.
- For used goods, if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
- The above restrictions and shortened deadlines do not apply to claims due to damage caused by us, our legal representatives or vicarious agents:
a) in the event of injury to life, body or health,
b) in the event of intentional or grossly negligent breach of duty or fraudulent intent,
c) in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on whose compliance the contractual partner can regularly rely (cardinal obligations)
d) as part of a guarantee promise, if agreed or
e) to the extent that the scope of application of the Product Liability Act is open.

§12 Warranty
- We assume no liability for the accuracy of information, illustrations, technical data, drawings, weight, dimension and service descriptions contained in circulars, advertisements or price lists. These are purely informational.
- Unless a written guarantee has been given, there is no guarantee for the fading or water resistance of printed products. Unless otherwise stated, our print products are intended exclusively for enclosed spaces.
- The designations and specifications specified at the time of conclusion of the contract represent the technical status at that time. Technical deviations (in particular image cropping and color of the printout) of the delivered goods from the advertised goods are permitted and do not constitute an error as long as they are within the usual commercial framework and the contractual purpose is not significantly restricted. Images that are cropped may deviate from the specified sizes or views, as is usual in the commercial world. Color differences in the printout may occur if the customer's monitor is calibrated differently and not true to color. Black/white prints may contain a slight, standard color cast due to color printing. Differences in brightness also depend on the setting of the monitor or screen. Complaints, credit notes and replacement prints in this regard are excluded unless the deviation is outside the usual commercial limits.
- The limitation period for claims arising from liability for material defects is 24 months.
§13 Data protection

§14 Destruction of sent files
- We reserve the right to make a backup copy of the customer's digitally transmitted files, templates and content in order to be able to guarantee immediate improvement in the event of a possible request for improvement by the customer. The stored data will be used exclusively for the purpose of improvement.
§15 Right of return and cancellation
- The right of cancellation and return for distance selling contracts in accordance with Section 312 g Paragraph 1 BGB is excluded according to Section 312 g Paragraph 2 No. 1 BGB if the goods are manufactured and cut according to the customer's specifications. For this reason, all individually manufactured products of this type are excluded from the right of return.
- You can cancel the order or return the item within 30 days of receipt of delivery. To meet the deadline, it is sufficient to send the cancellation or the item in a timely manner. Please add the order number. In order to improve our service and our products, we would also like to provide the reason for the return and cancellation. - The shipping costs from affengeilebilder24 to the customer will be refunded with the purchase price after the product has been returned to us. If the customer requests express shipping, we will only refund the standard shipping amount. In the case of free shipping, there is no entitlement to reimbursement of the fictitious shipping costs.
- Mouth masks are excluded from the right of return for hygiene reasons.
- Items that have already been used or processed (e.g. fitted to the frame by the customer themselves) cannot be exchanged.
§16 Delivery time
- Delivery takes place within 3-12 working days depending on the recipient location. In special cases, such as the COVID-19 pandemic, there may be delays in the supply chain, which can lead to longer delivery times.
§17 Trademarks
- The names, logos and lettering displayed on our website may not be published or used in any other way or form without our prior written consent.
§18 Dispute resolution

- We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
§19 Final provisions
- We reserve the right to change the terms and conditions at any time and without giving reasons. The customer will be made aware of a change. In the event of changes to the terms and conditions, the customer's renewed consent is required.
